These Terms & Conditions (“Terms”) govern access to and use of the website www.portuguish.pt, together with any related pages, content, digital products, subscriptions, lessons, features, communications, and services made available by Seven Links, Lda, trading as Portuguish (“Portuguish”, “we”, “us”, or “our”).

By accessing or using the Website, creating an account, purchasing any Product or Service, or otherwise interacting with Portuguish, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Website or any of our Products or Services.

2. Scope of These Terms

These Terms govern, among other things:

• access to and use of The Portuguese Puzzle;
• access to and use of The Foundation Course;
• participation in Live Lessons;
• use of downloadable, viewable, or otherwise accessible digital materials;
• submission of comments, reviews, messages, or other user content.

3. Eligibility

You may only use the Website and purchase our Products or Services if you are legally capable of entering into a binding contract under the laws applicable to you.

If you are under the age of majority in your jurisdiction, you may only use the Website or purchase any Product or Service with the involvement and authorization of a parent or legal guardian.

We reserve the right to refuse access, suspend accounts, or cancel purchases where we reasonably believe that a user does not meet these eligibility requirements.

 

4. Our Products and Services

Portuguish provides online educational products and services focused on European Portuguese.

Our offerings currently include, among others:

• The Portuguese Puzzle, a subscription-based digital membership;

• The Foundation Course, a one-time-purchase digital course;

• Live Lessons, delivered online;

• related digital learning materials and resources.

All Products and Services are provided digitally and online only.

Unless expressly stated otherwise, our Products and Services are provided for educational and informational purposes only and do not confer official certification, accreditation, or guaranteed exam outcomes.

 

5. User Accounts

Access to certain Products or Services requires the creation of an account and/or the use of third-party platforms.

Depending on the Product or Service, access may require the use of third-party tools or platforms such as Kajabi, Zoom, Brainscape, Stripe, PayPal, Apple Pay, Google Pay, Klarna, or similar providers.

You agree to provide accurate, complete, and current information when creating an account or making a purchase, and to keep that information updated.

You are responsible for maintaining the confidentiality of your account credentials and for all activity carried out through your account, except to the extent caused by our fault.

You must notify us promptly if you become aware of any unauthorized access to or use of your account.

 

6. Personal Use Only; No Account Sharing

Unless we expressly agree otherwise in writing, all Products and Services are licensed or made available to you for your personal, individual, non-transferable use only.

You may not share, transfer, sell, sublicense, lend, or otherwise make your account, login credentials, or purchased access available to any other person without our prior written consent.

Any unauthorized sharing may result in suspension or termination of access without refund, subject to applicable law.

 

7. Product-Specific Access Terms

7.1 The Portuguese Puzzle

The Portuguese Puzzle is offered as a recurring monthly subscription.

Access is granted only while the subscription remains active and paid. If the subscription ends or is terminated, access to The Portuguese Puzzle will end accordingly.

 

7.2 The Foundation Course

The Foundation Course is offered as a one-time purchase digital course.

Subject to these Terms, purchasers receive access on a lifetime basis for the commercial life of the product. “Lifetime access” means access for as long as Portuguish continues to make that product available in substantially that form as part of its business, and does not mean the lifetime of the purchaser.

We reserve the right to update, improve, modify, reorganize, replace, or discontinue parts of the course or its delivery format at any time, provided that we do not act in bad faith toward existing purchasers.

 

7.3 Live Lessons

Live Lessons are online instructional sessions provided by Portuguish and may be delivered through third-party video or communication platforms.

Live Lessons are subject to availability, scheduling, operational requirements, and any specific arrangements communicated at the time of booking, enrolment, or participation.

Fees for Live Lessons may become non-refundable once booked, confirmed, scheduled, or otherwise committed to for you, subject to applicable law and any specific terms presented at the time of purchase or enrolment.

 

8. Prices and Payment

All prices are displayed in EUR.

Unless expressly stated otherwise, prices shown on the Website include applicable VAT, where chargeable.

We may offer different payment methods depending on the Product, Service, user location, device, or platform. Not all payment methods are necessarily available for every Product or Service.

By making a purchase, you authorize us and our payment providers to charge the applicable amount, including any recurring charges, taxes, and fees, using your selected payment method.

You are responsible for ensuring that your payment information is valid, current, and complete.

 

9. Discounts, Promotions, and Trial Offers

We may offer discounts, promotional codes, coupon codes, introductory offers, time-limited deals, or trial offers at our discretion.

Unless expressly stated otherwise:

• promotions cannot be combined;

• promotions may be limited to certain users, Products, Services, or jurisdictions;

• promotions may be modified, withdrawn, or expired at any time;

• misuse of any promotion may result in cancellation of the offer and suspension or termination of access.

 

10. Subscription Terms for The Portuguese Puzzle

10.1 Billing and Renewal

The Portuguese Puzzle is billed on a monthly recurring basis, unless otherwise stated at the time of purchase.

Your subscription renews automatically at the end of each billing period unless you cancel before the next renewal date.

 

10.2 Free Trial

We may offer versions of The Portuguese Puzzle with or without a 7-day free trial.

If you sign up through an offer that includes a free trial, your subscription will automatically convert into a paid monthly subscription at the end of the trial period unless you cancel before the trial ends.

 

10.3 Cancellation

You may cancel your subscription at any time.

Unless otherwise stated at checkout or required by applicable law, cancellation will stop future renewals only. If you cancel during a free trial, no charge will be made, provided that cancellation takes place before the trial ends.

If you cancel after a payment has already been processed for a billing period, that payment is non-refundable except where mandatory law provides otherwise, and your access will continue until the end of the then-current paid billing period.

If you ask us to manually cancel your subscription with immediate effect, we may revoke access immediately. In that case, no refund will be due for any unused part of the current billing period, except where mandatory law provides otherwise.

 

10.4 No Pause or Freeze

We do not currently offer pauses, freezes, or temporary suspension of subscriptions unless we expressly agree otherwise in an individual case.

 

10.5 Subscription Price Changes

We reserve the right to change subscription pricing prospectively.

If we change the price of an existing subscription, we will provide reasonable prior notice, normally at least 30 days before the new price takes effect. The new price will apply from the next renewal date following the notice period.

If you do not agree to the new price, you may cancel your subscription before the new price takes effect.

 

11. Refunds and Withdrawal

11.1 General

Because our Products and Services are digital and/or provided online, refunds may be limited once access has been granted or performance has begun, subject always to applicable mandatory law.

Nothing in these Terms excludes or limits any statutory rights that cannot lawfully be excluded, including any applicable consumer rights relating to withdrawal, cancellation, or refunds.

 

11.2 The Portuguese Puzzle

Except where mandatory law provides otherwise, payments for The Portuguese Puzzle are non-refundable once charged.

If you sign up for a free trial, it is your responsibility to cancel before the trial period ends if you do not wish to be charged.

If you cancel after the trial period has ended or after a renewal payment has been processed, the cancellation will prevent future renewals only, and access will continue until the end of the current paid billing period, unless you request immediate cancellation.

 

11.3 The Foundation Course

The Foundation Course includes a 10-day money-back guarantee from the date of purchase.

To request a refund under this guarantee, you must contact us within that 10-day period at info@portuguish.pt.

After the 10-day period has expired, payments are non-refundable except where mandatory law requires otherwise.

 

11.4 Live Lessons

Except where mandatory law provides otherwise, fees for Live Lessons are generally non-refundable once booked, confirmed, scheduled, or otherwise committed to for you.

Any refund, cancellation, rescheduling, replacement lesson, or credit relating to Live Lessons shall remain subject to:

• applicable mandatory consumer law;

• the specific booking, scheduling, or offer terms presented to you at the time of purchase or enrolment; and

• any additional practical arrangements communicated for the relevant lesson, cycle, or offer.

Where no more specific terms are stated at the time of purchase, missed Live Lessons may be forfeited and we shall have no obligation to reschedule or refund them, except where mandatory law requires otherwise.

 

11.5 Immediate Access to Digital Content and Services

Where applicable law requires it, and in particular for certain consumers purchasing from the EU or EEA, by purchasing any digital content, digital service, subscription, or online service that is made available immediately after purchase, you expressly request immediate performance and acknowledge that your statutory right of withdrawal may be lost or reduced once performance begins or access is provided, to the extent permitted by applicable law.

 

12. Acceptable Use

You agree to use the Website and all Products and Services lawfully and in accordance with these Terms.

You must not, whether directly or indirectly:

• share your account or login credentials without permission;

• copy, reproduce, distribute, transmit, republish, sell, license, or commercially exploit our content;

• record lessons or content, including screen recording, audio recording, video recording, or similar capture methods, unless expressly authorized by us in writing;

• upload or distribute our content on third-party platforms, file-sharing services, social media, marketplaces, or repositories;

• use our content, materials, data, or Services to train, fine-tune, test, improve, or develop any artificial intelligence or machine learning system;

• interfere with or disrupt the Website, platform infrastructure, security features, payment systems, or related services;

• misuse promotions, payment systems, or chargeback processes;

• engage in unlawful, fraudulent, abusive, threatening, harassing, discriminatory, defamatory, or otherwise harmful conduct;

• impersonate any person or entity or misrepresent your affiliation.

 

13. Community and User Conduct

Where the Website or our Services include comments sections, live interactions, community spaces, or similar features, you agree to participate respectfully and lawfully.

We may remove content, limit participation, suspend access, or terminate accounts where we reasonably believe that a user has violated these Terms, acted abusively, disrupted the learning environment, infringed the rights of others, or exposed Portuguish or its users to risk.

In serious cases, we may remove a user from community features or Services without refund, subject to applicable law.

 

14. Intellectual Property

All intellectual property rights in and to the Website, Products, Services, and all related content are owned by or licensed to Seven Links, Lda.

This includes, without limitation:

• videos;

• audios;

• lessons;

• texts;

• quizzes;

• exercises;

• worksheets;

• PDFs;

• flashcards;

• branding;

• graphics;

• designs;

• logos;

• course structures;

• compilations;

• website content.

No ownership rights are transferred to you by reason of your purchase or use of any Product or Service.

You are granted only a limited, revocable, non-exclusive, non-transferable right to access and use the relevant Product or Service for your own personal, non-commercial use, strictly in accordance with these Terms.

 

15. User Content

If you submit comments, reviews, testimonials, homework, messages, emails, voice notes, or other materials to us (“User Content”), you represent and warrant that:

• you have the right to submit that User Content;

• the User Content does not infringe the rights of any third party;

• the User Content is not unlawful, abusive, misleading, or otherwise inappropriate.

You retain ownership of your User Content. However, by submitting it to us, you grant us a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, adapt, publish, display, distribute, and otherwise use that User Content for the purpose of operating, improving, administering, and promoting our business and Services, subject to applicable law and our Privacy Policy.

We are under no obligation to publish, retain, or use any User Content.

 

16. Testimonials and Reviews

We may publish testimonials, reviews, feedback, or other statements from customers or users on the Website or in our marketing materials.

Such testimonials and reviews reflect individual experiences only and do not constitute a guarantee of results, progress, fluency, speed of learning, or any other specific outcome.

 

17. No Guarantee of Results

We strive to provide useful, practical, and enjoyable language-learning experiences. However, we do not guarantee any particular result, including fluency, speed of progress, confidence, pronunciation, exam success, or conversational ability.

Learning outcomes depend on many factors, including prior knowledge, consistency, effort, learning style, level of participation, and time invested.

Any statements in our content or marketing regarding learning speed, learning efficiency, simplicity, or likely progress are illustrative only and are not guarantees.

 

18. Changes to the Website, Products, and Services

We reserve the right, at any time and without liability except as required by law, to:

• modify, update, improve, replace, reorganize, or remove parts of the Website or our Products and Services;

• add or remove features;

• update learning content;

• change third-party providers, tools, or platforms;

• suspend or interrupt access for maintenance, security, technical, legal, or operational reasons.

We do not guarantee that any specific feature, instructor, third-party integration, or platform will always remain available.

 

19. Third-Party Providers

Our Website and Services may rely on third-party providers, software, communication tools, payment processors, or hosting platforms.

To the extent permitted by law, we are not responsible for the independent acts, omissions, outages, policies, or terms of third-party providers.

Your use of any third-party platform or tool may also be subject to that provider’s own terms and privacy policies.

 

20. Suspension and Termination

We may suspend, restrict, or terminate your access to the Website, Products, Services, or account, with or without prior notice where appropriate, if:

• you breach these Terms;

• we reasonably suspect fraud, misuse, abuse, or unlawful conduct;

• you engage in unauthorized account sharing;

• you initiate chargebacks or payment disputes in bad faith;

Suspension or termination does not affect any rights or obligations accrued before the date of suspension or termination.

22. Limitation of Liability

To the fullest extent permitted by law, Seven Links, Lda and its directors, officers, employees, contractors, affiliates, and service providers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, business, goodwill, data, or opportunity arising out of or in connection with the Website or any Product or Service.

This includes, without limitation, losses arising from:

• use of or inability to use the Website or Services;

• service interruptions or technical failures;

• third-party platform outages or payment-provider issues;

• unauthorized access not caused by our fault;

• disappointment with learning outcomes or unmet expectations.

Nothing in these Terms excludes or limits liability for fraud, gross negligence, willful misconduct, death or personal injury where such exclusion is unlawful, or any other liability that cannot lawfully be excluded.

To the extent liability may lawfully be limited, our total aggregate liability in relation to any claim shall not exceed the amount paid by you to us for the relevant Product or Service in the 12 months preceding the event giving rise to the claim.

 

23. Indemnity

To the extent permitted by law, you agree to indemnify and hold harmless Seven Links, Lda against claims, liabilities, losses, damages, and expenses arising out of:

• your breach of these Terms;

• your misuse of the Website or Services;

• your infringement of any third-party rights;

• your unlawful or abusive conduct.

This clause applies only to the extent permitted by applicable law and shall not override mandatory protections available to consumers.

25. Complaints

If you have a complaint, please contact us first at info@portuguish.pt and we will try to resolve the matter promptly and fairly.

Consumers may also use any complaint or alternative dispute resolution mechanisms available under applicable law.

Where applicable, complaints may also be submitted through the Livro de Reclamações Eletrónico, the official Portuguese electronic complaints book, available at https://www.livroreclamacoes.pt/Inicio/. The availability of that mechanism does not limit any other rights or remedies you may have under applicable law.

 

26. Governing Law and Jurisdiction

These Terms are governed by the laws of Portugal.

If you are a consumer, this choice of law does not deprive you of any mandatory protections granted to you by the law of your country of habitual residence where such protections apply.

Any dispute arising out of or in connection with these Terms shall be submitted to the competent courts of Portugal, unless mandatory applicable law provides otherwise.

 

27. Business Users

Where a user or purchaser acts for purposes related to a trade, business, craft, or profession, certain consumer protections may not apply to that relationship to the extent permitted by law.

 

28. Changes to These Terms

We may update or amend these Terms from time to time.

The version published on the Website at the time of your use or purchase will generally apply, unless a revised version is required by law or expressly stated to apply prospectively.
